By visiting this Website, the User or Users shall be deemed to have accepted, declared and acknowledged that Hyperiser Media or any one of its group companies or affiliates or their employees or directors or any persons or entities authorized by them shall have no civil or criminal liability for any texts, information, comments, opinions, news, images, pictures, figures, diagrams, drawings, graphs and other contents belonging either to Hyperiser Media or to any third party person or entity and contained in the Website, or for interruption, delay or erroneous publication of any such contents, or for consequences of use of such contents or of decisions taken in reliance upon these contents, or for any probable direct or indirect, material or moral, negative or positive damages or any other potential damages and costs originating from their failure to read the conditions of use of the Website or their failure in compliance therewith, albeit being fully cognizant thereof, and also that Hyperiser Media has by no means given any representation or warranty as to accuracy and/or adequacy of information contained in the Website.

Furthermore, the User or Users shall also be deemed to have accepted, declared and acknowledged that Hyperiser Media or any one of its group companies or affiliates or their employees or directors or any persons or entities authorized by them shall have no civil or criminal liability for use of information that may be acquired due to or in reliance upon availability of Hyperiser Media logo or its website pages in another website or any contents that may be uploaded into the Website by third parties or visitors, or for any contents not leading to any liability originating from use of internet, within the frame of general applications pertaining thereto.

The User or Users acknowledge and accept that Hyperiser Media shall be entitled to unilaterally change, revise or update the Conditions of Use of Website or the Personal Data Protection Policy in its sole convenience and at any time deemed fit.

THE CLARIFICATION TEXT ON THE PERSONAL DATA PROTECTION

ICM Reklam San. ve Tic. Ltd. Şti. (hereinafter referred to as "ICM" or "Company".) provides services for the establishment of cooperation between Content Providers and / or Influencers who produce content on social media platforms such as Twitter, Instagram, TikTok, etc. and brands, companies and project owners that have the title of advertisers. In this context, personal data collected by ICM can be processed in accordance with the legislation, in connection with our area of activity and service objectives, and in a measured manner, can be transferred to third parties if necessary, and stored for periods in accordance with the legislation.

1. Definitions

ICM : ICM Reklam San. ve Tic. Ltd. Şti. is a company that operates Hyperiser application.

Customers : Brands and advertising agencies that use Hyperiser application.

HYPERISER : An application designed for customers to find Content Providers and / or Influencer contacts.

CONTENT PROVIDERS : It refers to creative people who produce, publish, advertise on social media platforms and have an active social media interaction network.

2. Legal Basis of Personal Data Collection

Personal data of the Creators and Customers are collected and processed in accordance with the provisions mainly in the Constitution of the Republic of Turkey, the Personal Data Protection Law ("KVKK") No. 6698, provisions contained in other relevant legislation and the decrees of other relevant legislations.

3. Collection Methods of Personal Data and Collected Personal Data

ICM processes personal data publicly provided by Creators only for use in the Hyperiser application and for the purpose of conducting advertising or brand collaborations between Content Providers and Customers. Personal data of Content Providers in the Hyperiser application are collected from the social media accounts of the Content Providers that are open to the public and that are made public by them. Collected personal data are separated according to the potential Content Provider accounts with which the Customers want to cooperate. In this context, ICM will carry out the cooperation between the parties upon the selection of potential Content Providers by the Customers through the Hyperiser application.

In this context, ICM processes personal data made public by Content Providers, who publicly share content from their social media accounts such as Twitter, Instagram, TikTok etc. with more than 1,000 followers.

ICM processes the following data by collecting them from social media accounts:

Username and / or channel ID used by Content Providers in their social media accounts,
Social media accounts of Content Providers,
Number of followers,
Number of accounts followed,
Profile photo used by Content Providers on social media,
Number of contents shared,
Shared and public content,
Scripts and hashtags used in shared content,
The number of likes, comments, views for the shared content,

In the event that a service contract is signed between the Creator and the Customers, the personal data collected from the Customers are as follows:

Company title,
Full name of the authorized person,
E-mail of the authorized person,
Phone number of the authorized person,
Financial information

Information we collect automatically:

IP addresses,
Location data,
Cookies,
Browser type and version,
Time zone setting,
Operating system and platform,
Session record

4. Purposes of Processing Personal Data

Personal data collected within the scope of the 3rd article is processed within the scope of the services offered by the Company and its field of activity, in accordance with the law and honesty rules, in an accurate and up-to-date manner, limited to the purpose of providing and conducting advertising or brand cooperation between Content Providers and Customers, in connection with the purpose for which they are processed, in a limited and measured manner, and by means of storing for the period foreseen or required for the purpose for which they are processed.

The Company will store the personal data collected by Content Providers from their social media accounts in the Hyperiser application for 1 (one) year and will destroy them in accordance with the legislation upon the end of this period.

5. Transfer of Your Personal Data

Personal data can be shared with business partners with whom the Company cooperates in order to carry out its services and activities, customers, and domestic and foreign enterprises that we receive data storage service in the cloud, pursuant to Articles 8 and 9 of the KVKK.

Necessary technical and administrative measures are taken to prevent violations of rights during data transfer to third parties. The Company is not responsible for the violations that occur in the risk area of the third party and due to the data protection policies of third parties.

Customers using the Hyperiser application will not share the Content Provider information accessed through the application with third parties. If it is determined that Content Provider information is transferred to third parties by Customers, direct and indirect damages will be compensated by the relevant Customer(s).

6. Rights of the Relevant Persons

As a relevant person, you have the right to question whether your personal data is being processed, to request information on this subject if it has been processed, to question the purpose of your personal data and whether it has been used in accordance with its purpose, whether it has been transferred to the country or abroad, to request correction if it has been processed incompletely or incorrectly, and to demand compensation, deletion or destruction if you suffer damage due to unlawful processing of your personal data.

To exercise your rights specified herein, you can send your request via e-mail, in accordance with KVKK Article no. 13, or to the address of ICM given below, with your name and last name and your signature included, in addition to your identification number if you are a citizen of the Republic of Turkey or your nationality, passport number and/or ID, if any, if you are not a citizen of the Republic of Turkey, including your permanent location and your workplace address with the declared electronic mail address and telephone number, as well as demand issues and the necessary information and documents required for detecting your identity, in writing or in order to get general information about KVKK.

Your application will be evaluated by ICM and will be finalized free of charge within 30 (thirty) days.

KİŞİSEL VERİLERİN KORUNMASI HAKKINDA AYDINLATMA METNİ

ICM Reklam San. ve Tic. Ltd. Şti. (bundan böyle "ICM" veya "Şirket" olarak anılacaktır.) Twitter, Instagram, TikTok vb. sosyal medya platformlarında içerik üreten İçerik Sağlayıcılar ve/veya Influencer'lar ile markalar, şirketler ve reklamveren unvanına sahip proje sahipleri. Bu kapsamda, mevzuat ile ICM tarafından toplanan kişisel veriler, faaliyet alanımız ve hizmet hedeflerimizle bağlantılı olarak mevzuata uygun olarak işlenebilmekte ve ölçülü olarak, gerektiğinde üçüncü kişilere aktarılabilmekte ve uygun sürelerle saklanabilmektedir.

ICM : ICM Reklam San. ve Tic. Ltd. Şti. Hyperiser uygulamasını çalıştıran bir şirkettir.

Müşteriler : Hyperiser uygulamasını kullanan markalar ve reklam ajansları.

HYPERISER : Müşterilerin İçerik Sağlayıcıları ve/veya Influencer kişileri bulması için tasarlanmış bir uygulama.

İÇERİK SAĞLAYICILAR : Üreten, yayınlayan, sosyal medya platformlarında reklam veren ve aktif bir sosyal medya etkileşim ağına sahip yaratıcı kişileri ifade eder.

2. Kişisel Veri Toplamanın Hukuki Sebebi

Oluşturucuların ve Müşterilerin kişisel verileri, başta Türkiye Cumhuriyeti Anayasası olmak üzere 6698 sayılı Kişisel Verilerin Korunması Kanunu ("KVKK"), ilgili diğer mevzuatta yer alan hükümler ve Türkiye Cumhuriyeti kararnamelerinde yer alan hükümlere ve diğer ilgili mevzuatlara uygun olarak toplanmakta ve işlenmektedir.

3. Kişisel Verilerin Toplanma Yöntemleri ve Toplanan Kişisel Veriler

ICM, İçerik Sağlayıcılar tarafından yalnızca Hyperiser uygulamasında kullanılmak üzere ve İçerik Sağlayıcılar ile Müşteriler arasında reklam veya marka işbirlikleri yürütmek amacıyla halka açık olarak sağlanan kişisel verileri işler. Hyperiser uygulamasında yer alan İçerik Sağlayıcıların kişisel verileri, İçerik Sağlayıcıların kamuya açık olan ve kendileri tarafından alenileştirilmiş sosyal medya hesaplarından toplanmaktadır. Toplanan kişisel veriler, Müşterilerin işbirliği yapmak istediği olası İçerik Sağlayıcı hesaplarına göre ayrıştırılmaktadır. Bu kapsamda ICM, Müşterilerin Hyperiser uygulaması üzerinden potansiyel İçerik Sağlayıcıları seçmesi üzerine taraflar arasındaki işbirliğini yürütecektir.

Bu kapsamda, 1.000'den fazla takipçisi olan Twitter, Instagram, TikTok vb.

ICM aşağıdaki verileri sosyal medya hesaplarından toplayarak işler:

İçerik Sağlayıcıların sosyal medya hesaplarında kullandıkları kullanıcı adı ve/veya kanal kimliği,
İçerik Sağlayıcıların sosyal medya hesapları,
Takipçi sayısı,
Takip edilen hesap sayısı,
Sosyal medyada İçerik Sağlayıcılar tarafından kullanılan profil fotoğrafı,
Paylaşılan içerik sayısı,
Paylaşılan ve herkese açık içerik,
Paylaşılan içeriklerde kullanılan metinler ve etiketler,
Paylaşılan içerik için beğeni, yorum, izlenme sayısı,

Müşteriler arasında bir hizmet sözleşmesinin imzalanması durumunda Müşterilerden toplanan kişisel veriler aşağıdaki gibidir:

Şirket ünvanı,
Yetkili kişinin tam adı,
Yetkili kişinin e-postası,
Yetkili kişinin telefon numarası,
Finansal bilgi

Otomatik olarak topladığımız bilgiler:

IP adresleri,
Konum verileri,
Çerezler,
Tarayıcı türü ve sürümü,
Saat dilimi ayarı,
İşletim sistemi ve platform,
Oturum kaydı

4. Kişisel Verilerin İşlenme Amaçları

3. madde kapsamında toplanan kişisel veriler, Şirket tarafından sunulan hizmetler ve faaliyet konusu kapsamında, hukuka ve dürüstlük kurallarına uygun, doğru ve güncel olarak, bunlarla sınırlı olarak işlenmektedir. İçerik Sağlayıcılar ile Müşteriler arasında işlendikleri amaçla bağlantılı olarak sınırlı ve ölçülü olarak ve işlendikleri amaç için öngörülen veya gerekli olan süre kadar saklanmak suretiyle reklam veya marka işbirliğinin sağlanması ve yürütülmesi amacı işlenirler.

Şirket, İçerik Sağlayıcıların sosyal medya hesaplarından topladığı kişisel verileri Hyperiser uygulamasında 1 (bir) yıl süreyle saklayacak ve bu süre sonunda mevzuata uygun olarak imha edecektir.

5. Kişisel Verilerinizin Aktarımı

Kişisel veriler, Şirket'in hizmet ve faaliyetlerini yürütmek üzere işbirliği içinde olduğu iş ortakları, müşteriler ve bulutta veri saklama hizmeti aldığımız yerli ve yabancı kuruluşlar ile KVKK'nın 8. ve 9. maddeleri uyarınca paylaşılabilecektir.

Üçüncü kişilere veri aktarımı sırasında hak ihlallerini önlemek için gerekli teknik ve idari tedbirler alınmaktadır. Şirket, üçüncü kişilerin risk alanında ve üçüncü kişilerin veri koruma politikaları nedeniyle meydana gelen ihlallerden sorumlu değildir.

Hyperiser uygulamasını kullanan müşteriler, uygulama üzerinden ulaştıkları İçerik Sağlayıcı bilgilerini üçüncü şahıslarla paylaşmayacaktır. İçerik Sağlayıcı bilgilerinin Müşteriler tarafından üçüncü kişilere aktarıldığının tespiti halinde doğrudan ve dolaylı zararlar ilgili Müşteri(ler) tarafından tazmin edilecektir.

6. İlgili Kişilerin Hakları

İlgili kişi olarak kişisel verilerinizin işlenip işlenmediğini sorgulama, işlenmişse bu konuda bilgi talep etme, kişisel verilerinizin amacına uygun kullanılıp kullanılmadığını sorgulama; yurt içine veya yurt dışına aktarılmış olması halinde eksik veya yanlış işlenmişse düzeltilmesini, kişisel verilerinizin kanuna aykırı olarak işlenmesi sebebiyle zarara uğramanız hâlinde zararın giderilmesini, silinmesini veya yok edilmesini talep etme hakkına sahipsiniz.

Burada belirtilen haklarınızı kullanmak veya KVKK hakkında bilgi almak için talebinizi e-posta ile KVKK Madde no.13 numaralı adrese veya aşağıda belirtilen ICM adresine, Türkiye Cumhuriyeti vatandaşı iseniz kimlik numaranıza ek olarak adınız soyadınız ve imzanız, Türkiye Cumhuriyeti vatandaşı değilseniz, beyan edilen elektronik posta adresi ve telefon numarası ile birlikte daimi yerleşim yeri ve işyeri adresiniz ile talep konuları ve kimliğinizin tespiti için gerekli olan gerekli bilgi ve belgeler de dahil olmak üzere iletebilirsiniz.

Başvurunuz ICM tarafından değerlendirilerek 30 (otuz) gün içerisinde ücretsiz olarak sonuçlandırılacaktır.

and in live broadcast shares, continuously in the video or in the title or description section of the video, or at the beginning of the section where the relevant advertisement will go, At least one of the following explanations is given in written and verbal form, without requiring consumers to click on a field such as "read more":

"This video contains ads of [the advertiser]."
"This video contains of a paid collaboration with [the advertiser]."
"With the support of [the advertiser]."
"I received these products from [the advertiser] as a gift."
"Thanks to [the advertiser] for sending me the products."

At least one of the following statements is included in written and verbal form at the beginning, middle and end of the broadcast in Advertisements Made Through Podcasts

"This podcast contains ads of [the advertiser]."
"This podcast consists of a paid collaboration with [the advertiser]."
"With the support of [the advertiser]."
"I received the products (which I mentioned in my podcast) as a gift from [the advertiser]."

A Social Media Influencer

is a person who communicates through a social media account in order to sell or rent a product or service belonging to her or the advertiser, to inform or persuade the target audience.

The advertisement should be distinguishable from the colors and background used in the sharing and should be in an easily readable size.
It should be stated in such a way and position that the sharing is understood as a commercial advertisement, without the need for consumers to do anything else when they first encounter the sharing.
In case other tags or descriptions are included in the post, it should be stated visibly among the tags or descriptions.
It should be presented in a way that can be noticed by consumers at first glance, taking into account the interface and technical characteristics of the medium where the sharing takes place.
